Does Carona Have Competition?

I've been hearing that Texas Senator John Carona will have a serious Democrat challenger in next year's Senate Race for District 16 (map).

The only Democrat challenger he's faced since he became senator in 1996 was the late Jan Erik Frederiksen in 2002, who pulled 34% of the vote in the general election.

John Carona has a ton of money, both personally and in the election coffers. Running as a Democrat in a district that includes the Park Cities and most of North Dallas will be a challenge for anyone, so I remain skeptical. Carona does have a democratic opponent this year, Rain Minns. But let's focus a light on Carona for a moment, shall we?

Carona recently accused the Dallas District Attorney of conflicts of interest (see report on Fox News http://www.myfoxdfw.com/myfox/pages/ContentDetail?contentId=6939475 ).
Carona has his own history of serious conflict of interest issues, which should now become front page news with indictments and trials just in time for the election this fall. If his local constituents find out his dirty little secrets, perhaps his reign of self-serving political influence will end?

The real conflict-of-interest story is found when you shine a light on Carona's voting history in the passage of legislation he authored in the property code. He is supposed to ABSTAIN from voting on any HOA bill - he is CEO and majority owner in THE LARGEST HOA MANAGEMENT COMPANY IN THE WORLD!!

The Texas Constitution - Article 3 - LEGISLATIVE DEPARTMENT
Section 22 - DISCLOSURE OF PRIVATE INTEREST IN MEASURE OR BILL; NOT TO VOTE: A member who has a personal or private interest in any measure or bill, proposed, or pending before the Legislature, shall disclose the fact to the House, of which he is a member, and shall not vote thereon.

That is pretty clear language in our constitution. The law stipulates a CRIMINAL OFFENSE for voting on legislation with conflicting interests:

Carona not only violates the constitution and the spirit of the constitution, he violates the law every time he has voted on any HOA legislation:

Most recently, Carona is recorded as voting on HOA bills in the 2007 session. Here is one example - read from the Senate Journal Wednesday, May 23, 2007 he is recorded as having voted on a bill that he should have abstained from voting on:COMMITTEEiiSUBSTITUTE HOUSE BILL 2402



CSHB 2402, Relating to the authority granted to certain property owners' associations in dedicatory instruments and restrictive covenants.

All Members are deemed to have voted "Yea" on the passage to third reading.

This is just ONE example from the 2007 session - there are other HOA bills he voted on. I have facts from the 2001 legislative session in which he voted on "the property owners protection act"- which is full of loopholes and should be called "the property owners association protection act". He wrote this law and deliberately fashioned the wording to do the opposite of what its label infers.

He has removed his name from all his websites within the last 6 months - apparently trying to hide the fact that he is the kingpin of the HOA industry, making him the biggest hypocrite in politics when he calls out another for conflicts of interests. I have copies of his HOA company websites from 2006 - where he was touted as the CEO/chairman of the board for Associa. This needs to come to light ASAP so that the Senate District 16 race puts an end to this domestic enemy of the constitution's reign.
